WYNWOOD BUSINESS IMPROVEMENT DISTRICT PRIVACY POLICY

Wynwood Business Improvement District and its subsidiaries and affiliates (collectively, “Wynwood BID,” “we,” “our,” or “us”), respect your privacy concerns. This Privacy Policy explains the privacy practices for Wynwood BID’s website, domain names, features, content, software, and any other mobile and/or online services we own, operate, or offer from time to time in connection with the foregoing (collectively, the “Service”) and applies to all visitors, users, and others who access the Service (“you,” “your,” or “user”).

WHAT DOES THIS PRIVACY POLICY COVER? This Privacy Policy covers how we collect, use, disclose, transfer, and store your information and does not apply to the privacy practices of companies that we do not own or control, or to individuals that we do not employ or manage, even if you have accessed the Internet sites or services of those companies through the Service.  We do not sell or otherwise disclose your Personal Information, except as described in this Privacy Policy.

WHAT INFORMATION DOES WYNWOOD BID COLLECT? We gather various types of information from you for purposes such as communicating with you, customizing and analyzing your experience with us, and/or to otherwise measure, understand, and improve the Service. Personal information is information by which you, or the device you are using to connect to the Internet, can be identified such as your name, phone number, email address, geographic location, and any other personally identifiable records (“Personal Information”).

• Information You Provide Us: We may collect Personal Information and other data you provide us on or off the Service in any way including when you search, purchase, create an account, signup for newsletters, contact us, participate in a contest or survey, share your personal interests and preferences, and/or otherwise interact with the Service. All emails and other communications between you and Wynwood BID may be archived. You are responsible for ensuring that your personal information and preferences on the Service are accurate,. current and complete by updating your Account Settings.

• Information Collected Automatically: We may collect information and other data from you automatically through cookies, pixel tags, and other technologies to do things such as make the Service easier or faster to use; authenticate your account; deliver personalized content; understand and improve our advertising; monitor and analyze the use of the Service; and to protect you, others and us. • Social Networking Channels: When you use any third-party social networking channels (such as Facebook, Twitter, Snapchat and Instagram) to engage us and/or the Service, you may automatically enable us to have access to Personal Information and other data from your social network account to do things such as offer you exclusive content; communicate with you on or off such channels; and otherwise use such information in accordance with this Privacy Policy. You also may enable us to post comments, reviews and other content on your social network account including, but not limited to, your walls and feeds. Any information we post in such areas may become available to other users and/or members of your social network. HOW DOES WYNWOOD BID USE THE INFORMATION IT COLLECTS? We may use the Personal Information and other data we obtain about you to register, authenticate, manage and maintain your user account; provide products or services you request; record, process, validate, deliver and track your transactions; communicate with you about our products, services, offers, events and promotions; publish your testimonials about Wynwood BID on and off the Service; manage your participation in our events, sweepstakes and other promotions; tailor our products and services to suit your personal interests and the manner in which users access the Service; operate, evaluate and improve the Service; analyze and enhance our communications and marketing strategies (including by identifying when emails sent to you have been received and read); analyze trends and statistics regarding how the Service is used; protect against and prevent fraud, unauthorized transactions, claims and other liabilities, and manage risk exposure; enforce our Terms of Use, agreements and other policies; and comply with applicable legal requirements and industry standards.We also may use cookies to identify and authenticate users. DOES WYNWOOD BID SHARE THE INFORMATION IT RECEIVES? We may share your Personal Information and other data with our affiliates and subsidiaries and other third parties for the purposes described in this Privacy Notice, including to communicate with you about our products, services, offers, events and promotions that we believe may be of interest to you. We also may share your Personal Information and other data with our service providers who perform services on our behalf such as information processing, order fulfillment, product delivery, managing and enhancing customer data, providing customer service, assessing your interest in our products and services, and conducting customer research or satisfaction surveys. These service providers are not authorized by us to use or disclose this information except as necessary to perform services on our behalf or comply with legal requirements.We also may disclose your Personal Information and other data (i) if we are required to do so by law or legal process (such as a court order); (ii) in response to a request by law enforcement authorities; (iii) to enforce our Terms of Use, agreements, and other policies; or (iv) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity. We may retain your Personal Information and other data as long as your account is active or as needed to provide you services, comply with our legal obligations, resolve disputes, and enforce our agreements.

   As a general rule, the Wynwood BID may be required to disclose any personally identifiable information collected on the Service where we receive a request to disclose information that is public information under the State of Florida statutes or other applicable laws. You should be aware that Florida Statute 119 declares that it is the policy of the State of Florida that all state, county, and municipal records shall be open for personal inspection by any person, and thus information collected by the Wynwood BID resulting from the use of its Service may be subject to examination and inspection upon request, if such information is a public record and not otherwise protected from disclosure by statute.  Under Florida law, e-mail addresses are public records. If you do not want your e-mail address released in response to a public records request, do not send us electronic mail. Instead, contact our office by phone or in writing.

5. HOW IS INFORMATION SECURED? Wynwood BID cares about the integrity and security of your Personal Information. We use a variety of commercial security measures to protect your information. However, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures or use your Personal Information for improper purposes. You acknowledge that you provide your Personal Information at your own risk.  We encourage you to protect your passwords and devices against unauthorized use and to sign off after using a shared connection to the Internet.

WHICH INFORMATION CAN USERS ACCESS? The Service gives you access to a range of information about your account with us for the limited purpose of viewing and, in certain cases, updating information such as your contact information, communication preferences and/or other services. We may decline to process requests that are unreasonably repetitive, require disproportionate technical effort, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by local law. You may choose not to provide us with information and/or request that we disable your account to prevent any future activity through that account. Should you choose not to provide us with your information, you may not be able to access some and/or all of the features of the Service. Because we have to communicate with you about orders that you may place with us from time to time, you cannot opt out of receiving emails related to your orders. You are responsible for ensuring that your information and preferences on the Service are accurate, current and complete by updating your Account Settings.

7. CHILDREN’S PRIVACY: Any use or access to the Service by anyone under 13 is strictly prohibited. If you are under 13, please do not attempt to register for the Service nor send us any information about yourself. If we learn that we have collected personal information from anyone under age 13, we will delete that information as quickly as possible.
